These Terms and Conditions ("Terms") govern your use of Logomax.com ("Logomax"). By accessing or using our website, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use our services.
By using Logomax, you confirm that you are at least 18 years old or have the legal capacity to enter into a binding contract under the laws of your jurisdiction. You agree to use the website in accordance with these Terms and all applicable laws and regulations.
To purchase a logo or use certain services on Logomax, you must create an account. You agree to provide accurate, complete, and up-to-date information during registration and to promptly update such information if it changes. You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account. You must notify Logomax immediately of any unauthorized use of your account.
Logomax offers logos for purchase under an exclusive ownership model, meaning the logo will be permanently removed from the marketplace upon purchase, and full ownership of the logo design is transferred to the customer. Prices for logos are displayed in various currencies depending on the customer’s location. Logomax reserves the right to change prices at any time without prior notice. Once a purchase is confirmed, the customer will receive the logo files in multiple formats, including PNG, JPG, PDF, EPS, and SVG.
All payments for logos and services must be made in full at the time of purchase. Logomax accepts major credit/debit cards and PayPal as payment methods. All transactions are processed securely, and no financial information is stored on our servers. Prices are inclusive of applicable taxes unless stated otherwise, and customers are responsible for any additional taxes, duties, or charges imposed by their local jurisdiction.
Logomax displays prices in various currencies based on the customer’s location. All prices listed exclude applicable taxes unless specified. The customer is responsible for paying any taxes, duties, or other charges applicable in their country.
Upon the successful completion of payment, customers can immediately download their purchased logo files from their Logomax account. The files provided include multiple vector and raster formats to ensure versatility in both digital and print applications. If the customer opts for the free customization service, the customized files will be available for download after the completion of the revisions.
By purchasing a logo from Logomax, the customer is granted full ownership of the logo design. This ownership provides the customer with exclusive rights to use and modify the logo across all platforms and media, including websites, social media, merchandise, and printed materials. No other individual or business will have access to the same logo, ensuring it remains unique to the customer’s brand.
With full ownership of the logo, customers are encouraged to register their logo as a trademark to further protect their brand identity. Logomax thoroughly reviews every logo to minimize the risk of copyright or trademark infringement. However, due to the complexity and the vast number of existing logos, Logomax cannot guarantee that the logo, including the brand name provided by the customer, is free from existing copyright or trademark issues. The responsibility to ensure that the logo, including any text or brand name provided by the customer, does not infringe on third-party intellectual property rights rests solely with the customer. Logomax is not liable for any legal issues that may arise from the use of the logo.
These Terms are governed by the laws of Mexico. Any disputes arising from or related to these Terms, the use of Logomax, or the purchase of logos shall be resolved in the courts of Mexico City, Mexico. By using this website, you consent to the exclusive jurisdiction of these courts.
Logomax offers a free customization service that allows customers to adjust the text and colors of their purchased logo. This service must be initiated within 30 days of purchase. Customers are required to respond to any revisions or follow-up questions from the Logomax team within 10 days. Failure to respond within this timeframe or to start the customization process within the 30-day period will result in the forfeiture of the free customization service. This service is limited to three revisions. If additional revisions are requested, they will be charged at a rate of $39 per revision. No refunds or discounts will be provided for unused customization services, as they are considered complimentary add-ons. Additionally, if the customer is dissatisfied with the customized logo, no refunds will be issued for the logo purchase.
All logos and content on Logomax are the intellectual property of the Company until purchased. Upon purchase, full ownership is transferred to the customer. Any unauthorized use, reproduction, or distribution of logos or content from Logomax is strictly prohibited and may result in legal action.
Logomax does not offer any warranties or guarantees regarding the quality, suitability, or accuracy of the logos provided. It is the customer's responsibility to thoroughly review the logos for any errors or issues before finalizing their purchase. In the event that a customer discovers an error in a logo within 60 days of purchase, Logomax will correct the error free of charge. Customers must use the ticketing system to report any errors within this timeframe. After 60 days, Logomax is not liable for correcting any errors in the logo or for any costs incurred by the customer due to such errors.
Due to the digital nature of our products, all sales are final. Once a logo has been purchased and the files have been delivered, no refunds will be provided. This policy applies to both non-customized logo purchases and those involving customization services. Customers are encouraged to thoroughly review all available information and consult with Logomax support if necessary before finalizing a purchase.
Logomax offers a Logo Backup Service for $5 per month, billed annually at $60. This service securely stores your logo files beyond the initial 60-day period, ensuring they remain accessible from your Logomax account at any time. The Logo Backup Service provides peace of mind by safeguarding your logo files, but it does not constitute an ownership transfer or additional rights beyond the original purchase.
Logomax and the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the website or the purchase of any logos. This includes, but is not limited to, damages for loss of profits, goodwill, data, or other intangible losses, even if Logomax has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Logomax, the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or in any way connected with your use of the website, purchase of logos, or breach of these Terms. This indemnification extends to any claims of intellectual property infringement related to the use of your purchased logo.
